California Employee Privacy Notice

IQAir North America, Inc. (“we,” “our,” or “IQAir”) provides this Employee Privacy Notice to all California-based employees, applicants, interns, contractors, and volunteers (“you” or “Employee”) in compliance with California law, including the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CCPA/CPRA”).

  • This Notice applies to all IQAir employees, applicants, contractors, interns, and volunteers.
  • This Notice applies solely to individuals residing in California.
  • This Notice is effective as of April 14, 2026.

3. Categories of Personal Information Collected

We collect the following categories of personal information about Employees:

  • Identifiers (e.g., name, address, email, phone number, government-issued identifiers)
  • Professional/education information (e.g., resume, work history, qualifications, background check information)
  • Employment-related information (e.g., job title, compensation, performance evaluations, disciplinary records)
  • Financial information (e.g., bank account information, payroll records, tax withholding information)
  • Health and benefits information (e.g., benefits enrollment, medical leave information, drug screening results where permitted by law)
  • Internet or network activity information (e.g., IP address, login data, system access logs, usage of company systems)
  • Audio, electronic, or visual information (e.g., security camera footage, call recordings, virtual meeting recordings)

4. Sensitive Personal Information

We may collect the following categories of sensitive personal information (“Sensitive Personal Information”):

  • Government identifiers (e.g., Social Security number, driver’s license, passport number)
  • Financial account information (e.g., bank account, payroll information)
  • Health and medical information (e.g., benefits, leave of absence information)

We use Sensitive Personal Information only for purposes permitted by California law, including to administer employment, payroll, and benefits, comply with legal obligations, and ensure workplace safety and security.  We do not use or disclose Sensitive Personal Information for purposes that would require offering a right to limit its use.

We obtain your personal information from the following sources:

  • You directly (e.g., application forms, onboarding documents, communications)
  • Co-employers or joint employers, including our Professional Employer Organization (“PEO”)
  • Service providers and vendors (e.g., payroll processors, benefits administrators, background check providers, recruiting platforms such as LinkedIn)
  • Internal systems and monitoring tools (e.g., network systems, security systems)
  • Government agencies or public records (e.g., tax authorities, employment eligibility verification)

6. Purposes for Collection and Use

We collect and use Employee personal information for business and employment purposes, including to:

  • Administer payroll, compensation, benefits, and tax withholdings
  • Recruit, evaluate, and hire job applicants
  • Manage employment relationships, including performance, promotions, and training
  • Ensure network security, system integrity, and workplace safety
  • Monitor use of company systems consistent with applicable law and company policy
  • Comply with legal and regulatory obligations (e.g., tax, immigration, labor, and workplace safety laws)
  • Investigate workplace incidents, complaints, or misconduct

We do not use automated decision-making or profiling technologies in connection with employment decisions.

7. Disclosure of Personal Information

We may disclose personal information to the following categories of third parties:

  • Co-employers or joint employers, including our PEO
  • Service providers and vendors (e.g., payroll providers, benefits administrators, IT service providers, recruiting platforms such as LinkedIn)
  • Government agencies or law enforcement where required by law
  • Professional advisors (e.g., auditors, attorneys, consultants
  • Affiliates (entities under common ownership or control with IQAir)

We do not sell or share Employee personal information as those terms are defined under California law.

8. Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described above, including to meet legal, regulatory, tax, accounting, and operational requirements. Retention periods vary by category of information and may include:

  • Identifiers and employment records: duration of employment plus applicable statute of limitations period
  • Payroll and tax records: at least 4 years
  • Benefits and health-related information: as required by applicable law
  • Background check information: as required or permitted by law
  • System access logs: as necessary for security and auditing purposes
  • Security camera footage: generally up to 60 days, unless needed for investigation

Retention periods may be extended where required by law or for legitimate business needs such as litigation, investigations, or audits.

9. Employee Rights under California Law

Under California law, you have the following rights, subject to certain exceptions:

  1. Right to Know/Access – Request disclosure of the categories and specific pieces of personal information we have collected about you, including sources, purposes, and categories of recipients.
  2. Right to Delete – Request deletion of personal information we have collected from you.
  3. Right to Correct – Request correction of inaccurate personal information.
  4. Right to Non-Discrimination – You will not be retaliated against for exercising your rights.

Because we do not sell or share personal information, we do not offer a right to opt out of such activities.
